4. online audio and video conferencing (conference tools)

Data processing

In the following, Smart Care GmbH informs about the processing of personal data in connection with the use of the CareSpan online conferencing tool for audio and video consultation and communication.

Purpose of processing

The purpose of the processing is to provide audio or video consultation for communication with patients / people in need and physicians / medical officers. The service is provided by CareSpan USA, Inc. The tool is operated on Smart Care GmbH's own IT infrastructure in Germany (EU).

Responsible

Smart Care GmbH, Schusterstraße 3, 19055 Schwerin, Germany, is responsible for data processing in the context of hosting audio or video consultation sessions.

What personal data is processed?

User details: company, first name, last name, e-mail address, phone.

Meeting metadata: IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and connection type.

Cloud recordings, chat/instant messages, voicemails uploaded photos and videos, files, whiteboards and other information shared while using the service.

Telephone dial-in: Incoming and outgoing phone number; country name; start and end time; IP address; etc.

Scope of processing

We use CareSpan to conduct audio and video consultations. If a recording is made, we will transparently communicate this in advance and ask for your consent if necessary.

Furthermore, CareSpan processes the duration of the consultation, start and end (time) of participation, number of participants and other "contextual information" related to the communication process (metadata).

If necessary for the outcome of an audio or video consultation, the chat content is logged.

The audio or video consultation data recorded directly by us via the CareSpan tool is deleted from our systems as soon as you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies. Mandatory legal retention periods remain unaffected.

Legal basis of data processing

The legal basis for data processing when conducting audio and video consultations is Art. 6 para. 1 lit. b) DSGVO.

Recipients / disclosure of personal data

Personal data processed in connection with participation in an audio or video consultation will not be disclosed to third parties as a matter of principle, unless they are intended for disclosure from the outset. In this case, we will obtain your consent/agreement.

Storage period The data collected directly by us via the video and conference tools is deleted from our systems as soon as you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies. Mandatory legal retention periods remain unaffected. 

Handling of applicant data 

We offer you the opportunity to apply to us (e.g. by e-mail, by post or via online application form). In the following, we inform you about the scope, purpose and use of your personal data collected as part of the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection 

If you send us an application, we will process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is § 26 BDSG-neu under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b DSGVO (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a DSGVO. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application. 

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of Section 26 BDSG-neu and Art. 6 (1) lit. b DSGVO for the purpose of implementing the employment relationship.

Data retention period 

If we are unable to make you a job offer, if you reject a job offer, or if you withdraw your application, we reserve the right to retain the data you have provided on the basis of our legitimate interests (Art. 6 Para. 1 lit. f DSGVO) for up to 6 months from the end of the application process (rejection or withdrawal of the application). Subsequently, the data will be deleted and the physical application documents destroyed. Retention serves in particular for purposes of proof in the event of a legal dispute. 

If it is evident that the data will be required after the expiry of the 6-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies. Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a DSGVO) or if legal storage obligations prevent deletion.

Inclusion in the applicant pool 

If we do not make you a job offer, it may be possible to include you in our applicant pool. In the event of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies. Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 para. 1 lit. a DSGVO). The provision of consent is voluntary and is not related to the current application process. The data subject may revoke his/her consent at any time. In this case, the data from the applicant pool will be irrevocably deleted, unless there are legal reasons for retention. The data from the applicant pool will be irrevocably deleted no later than two years after consent has been given.
